They are terminating you and charging you for it - I would like to see that one go to court. Especially as the reasons for termination are not accurately defined.

Very interesting, I will talk to my Verizon account manager about this.
I attended their MW Sympoisum recently. I was told that the terminations were all legit, and were the result of "months" of usage over the norm, not just one spike month. Ironically, what I see here is that people are being terminated "due to the last 30 days" usage. This seems in contrat to what I was told at the symposium. I also asked, what was "normal" usage, in terms of data. I was told "around 3 gig" we start looking.
As I look at Verizon for my business, I will make sure I have answers to these questions. 1) What is normal and what does unlimited really mean?
2) If one of my associates gets a termination letter, what is the process to verify and retort?
3) Why does there seem to be a difference in tethered and non-tethered in terms of "unlimited data"? |

I recently received a disconnection notice from Verizon stating that had violated the terms and conditions of the service contract. However my connection is used for work and is strictly used for web browsing (Safari, Internet Explorer), email (IMAP, POP3, Gmail, etc) and Intranet access (Cisco VPN Client).
I called 'Bridget' at Verizon Fraud Prevention (404-845-6457) and inquired as to how they came to the conclusion that I had violated their policy. She stated that although my usage complied with the terms and service that the total amount transferred was considered excessive. After alot of "But I pay for an "unlimited" connection" arguing she finally clarified that there is a blanket clause in the contract that states that anything that you do that Verizon considers a service 'disruption' is a violation of the agreement and may be immediately terminated (I was given a 1 week notice). The the notice I received stated that I would not have to pay for an early disconnect fee.
So I asked, what is considered a disruption of service, and she stated that any usage that was outside the "average use" was considered a disruption. This "average use" was stated to me as 33MB/day (1GB/month). Anthing over 1GB/month will initiate a warning letter and possibly a phone call from the Fraud Prevention department. Anything over 10GB/month will initiate an service termination.
I consider this unacceptable, $80/month for 1GB or 10GB is worthless.
Verizon should simply stop saying it's an unlimited connection and start saying 1GB soft limit, 10GB hard limit or ELSE!
Just for fun I checked my total transferred amount after browsing slashdot.org, cnn.com, gizmodo.com, evdoinfo.com, and finally went shopping on the apple.com store. My combined upload / download usage was almost 45MB. I guess I disrupted their service! Then I downloaded my email from my pop3 server and received another 25MB. Now I guess I'm really messing them up! sheesh, wake up and smell the bandwidth, browsing the media rich internet and email for more than an hour will easily exceed their "average user profile". Who are these average users anyways?
Well I don't hold the Evdoinfo guys liable at all, but it sure sucks that I'm now stuck with a Kyocera KR1, KPC-650, and Verizon supplied external antenna .... over a $400 investment.
Anyone interested in some EVDO gear?
Plus I've got over 10 of our sales people at work using Verizon EVDO connections and 8 of them have received service terminations. Looks like Verizon just lost over $12,000 in revenue from us!
Just to note, I used to have a Sprint 1xRTT connection which I readily admit, I abused ... everyday! Never received a warning, a phone call, nothing. Perhaps they are different now, please let us know if Sprint has decided to be unreasonable as well.

I barely had my account open for 2 months before I was terminated. I guess that qualifies as "months" of usage.
FWIW, in the three days between the time I got the letter and the time my service was stopped, I did abuse the service. At that point, I figured I might as well pull everything I could. |

I have an easier solultion than the legal route - take it as a silver lining to the dark looming cloud that is VzW…you have an alternative! one that is better performing (read the many candid msgs posted on EVDO FORUMS), less restrictive and comes with better assistance when needed: Sprint Mobile Broadband.
It covers more of the US, more population, more airports. Sprint's network reaches higher speeds more consistently than VzW, and it'll have it's next gen network (Rev A) rolled out by EOY.
Then thank VzW for helping you see the light! |

I am waiting for Sprint to get coverage at my location. I am just outside town and Sprint don't seem to cover the outer edges of cities as much as Verizon but there again I haven't checked for a while.

Had anyone been terminated and charged the $175 early termination fee under the new updated contract wording? With the publicity of the Cingular/ATT lawsuits it shouldn't be long before a class action suit gets started, but five years to settle. Kudos to deathlock42 for his post and trying to deal with the special people on the termination 800 phone number to get clarification that 33MB a day is considered normal usage. I gave up after I was accused of fraud, told the evidence has been forwarded to their legal department, and that I should be grateful they are allowing me out of my contract and not taking further action.
I think my 80 year old godmother does 33MB a day on her AOL dialup account. Does anyone have statistics on what the average internet user uses? I am a consultant and recieve email attachments larger 33MB several times a day, and I pay extra to my ISP for the privledge. I too am now stuck with a $300 kpc650 and external antenna which is useless, activation fee for a service I had for only 47 days, not to mention billable time lost, frustration and disgust.
If EVDO runs at 700Mb typical and busts to 2Gb, how many minutes before you exceed 33MB/day usage? |

In another post I pointed out that watching ONE medium size movie trailer on apple.com consumed about 15 Megs of downloaded data. That is via a web browser and I would assume fits the surfing and email only concept.
I downloaded an update for Stuffit and the Google.earthviewer.Mike thingy (WOW, that's gonna eat up the bytes), and a few other things and soon I was over 75 Megs for less than half an hour or so.
So, if I really worked it I would be over 300 Gigabytes this month...  |

Assuming you meant to write 700Kb and bursts to 2Mb for EVDO speeds; and just going with the average 700Kb, gives you...

Howdy,
Called Verizon this evening (I'm researching on which service I should get), and I was told that after 10GB in a month, I would receive a warning letter, after 20GB the service would be terminated. I asked why they're advertising this as "unlimited", and the sales rep responded that I should contact their advertising department.
He was actually quite straight forward with me about the limits. He mentioned they recently got an email regarding the change. If they disclosed this in their advertising, I might still be thinking about purchasing the service. With whomever I choose for data, I will transfer my cell as well. However, now, after reading this forum, I am strongly thinking about switching my phone service regardless.
Hope you guys get reimbursed for your terminations. Hope Verizon wises up, and actually offers unlimited access.

My usage for the last 22 days is 1.4 GBs and Im wondering if this is considered heavy usage? It looks like my data usage each month is going to run up to 2.5 gigs a month. I assume this above average amount of bandwidth usage or too heavy?
Verizon needs to change it's pricing plan, rather then cut off their customers. |
