I too found out about the 5GB cap from this website, called sprint the next day and after being told 10 different things by 10 different clueless people I asked for retentions, spoke to a manager and they confirmed what was said on this board. He told me they reserve the right to terminate your service after 5GB, doesn't mean they will.
To me this isn't worth losing my only chance to get out of the ETF, which I took and am switching back to my 200 dollar a month hughes account that gives me up to 1 GB per day of download. The latency sucks and its as much as a car payment but its better than 5 GB a month!
It gets better. I went into a Sprint store today to settle my final bill and just as I walked in a wealthy looking businessman was about to sign a deal on the card, THEY WERE TELLING HIM IT WAS STILL UNLIMITED! ITS JULY 17! I promptly told him my experience and the new TOS. Come to find out he is in the same situation we are, in the sticks torn between satellite and Sprint, with a son who wants to download videos.
The Sprint rep started saying it wasn't true and said that "Computers these days come with 3 Gigs but noone ever uses that much"
I politely told her she had no idea wtf she was talking about and that computers today come with 3 GHZ processors, and that the typical storage space is 300-500 GB. The man asked me a few more questions, and ultimately walked out of the store.
I couldn't believe Sprint was going to sign him up for a plan telling him it was UNLIMITED when he was about to sign a contract with the fine print stating "under 5GB"
Talk about truth in advertising.... an analogy would be this:
LEASE A BRAND NEW CADILLAC WITH UNLIMITED MILES PER YEAR*
*Just kidding, you actually only get 500 miles
As silly as that sounds, that's basically what they're doing. I'm contacting a lawyer about this next week for a possible class action suit. Please respond to this thread if you are interested in joining it, or you you know of one already in progress, or if you have a relative who is a lawyer that could give better advice.
BTW the bill I received they claimed warned me of the change mentions no such thing, just hearing aid crap, and my online meter still says unlimited, but obviously unlimited = 5 GB in sprint language. This must be stopped, even if none of us benefit more than our equipment fees refunded I would like to see Sprint suffer.

Oh, and ANOTHER thing, is there any particular reason why Sprint hires these clueless clipboard monkeys who think a Gigahert has something to do with storage space and bandwidth, but won't even call me back for an interview? My god, I'm stuck delivering pizza to pay for college when I could do their job in my sleep! |

I think the clueless rep was referring to RAM not the processor speed, but still pretty funny. Not really, but there ya have it.  |

Hahah, comparing 3GB of RAM to 5GB of data-transfer...what the heck? *laughs*
also I'd contend there are a number of people out there who do use or need that much...though not many.
Either way, I'd say this stems more from incompetence on Sprint's part rather than foul play--their website says 5GB (unlike Verizon, who for the longest time said it was "unlimited" when it was really 5GB), they sent out a notice to all their customers, and their top-people know it's 5GB....so I wouldn't say it's intentional deception on their part.
They do need, however, to better communicate to everyone that it is no longer unlimited anymore.....I'd say, give it another few months before you get your feathers in a ruffle  |

Well, far be it for me to miss out on a good time.
OP, if you launch a class-action... let me know. I'll get notifications of additions to this thread.. so just come on back and post here.
I have a corporate liable account, I haven't been notified in writing of the change, and I've called Sprint three times in the past month or so and have gotten three different answers.
4 days left on my current billing cycle and I've used about 10 gig. |

I filed a complaint with the Maryland State Attorney General about 5 or 6 weeks ago and I just got a very serious message on my answering machine from the Sprint Nextel Offices concerning a complaint that was filed on my behalf by the State of Maryland in regards to the 5 GB cap issue, specifically my attempt to cancel the service and being told that since I have never used more than 5 GB in a billing cycle that the change in the contract terms doesnt mean I can cancel my account without paying the ETF since it doesn't affect me.
I wont be able to call them back until monday though. |

Please save the message until you can record it. If your computer doesn't have other recording software, use SystemRoot\\system32\SoundRecorder.exe . From the diverse collection of misinformation from CS reps documented on this forum, the MSAG's investigators can find all the evidence they need that Sprint management has used its CS Department of confuse and misinform Maryland Sprint customers and others re the 5 GB cap to their detriment
Along with a recording of Sprint's call, refer the MSAG to this forum so they can see the myriad of misinformation customers have received.

I would imagine the MSAG will have a field day because its charter is not just what is legal, but what is fair.
If you need help recording or posting the file to the web for all, I'm sure we have many EVDOforum members who would be happy to assist. It's a talented crowd. For YouTube, a slideshow of select provisions of the T&Cs, the notice on the bills, explanations CS has given, and the many appearances of the word "unlimited" could provide a video backdrop for the recording. Eh. Class action suit won't help me. I just want to be able to use the service again. I want to give Sprint my money. I want to see a competitive mobile broadband marketplace.
How about someone find the memo that changed hands between AT&T, Sprint and Verizon where they all decided to price their products the same and institute the same arbitrary cap on usage; and then show it to the Dept. of Justice and have them file a antitrust suit in federal court. That's what I want.
Because you know it happened. Sprint was gaining customers from AT&T and Verizon as they jumped ship. When you have customers throwing money at you, you improve your infrastructure, continue to innovate, and compete accordingly. You don't just pushing them away and terminating customers, especially when the marginal cost for their additional usage is damn near zero.
I mean, christ, at least Verizon has the audacity to charge you $256/GB when it costs them a grand total of $0.00. |
