1. Sprint can in fact change my contract in mid-stream? When I signed up a year ago, I made sure that it was UNLIMITED data usage and everybody at Sprint assured me that I don't have to be worried about how much data I'm using. But legally they can change the terms of their contract with me before it reaches its two year term I signed for, right?

Yes, this is true. Read your contract and you will clearly see that they reserved the ability to do this. However, you don't have to agree to any material contract changes and if you don't agree you may end the contract without triggering the ETF or any other fees other than what you owe for services rendered through the end date of your service with Sprint.

If you continue to use the service after the new contract takes effect you agree to the new terms and are bound by them.

Okay, so let me get this all straight from what I'm gathering from all that you guys are saying:

2. This won't take effect until July 13th, correct? So I can use all I want until that time. After July 13, I have to watch that I don't go over 5GB/month, correct?

3. They can do a variety of things if I go over the 5GB limit: a) they can throttle back my speed b) they can limit the amount of data I use from that point on c) they can terminate my service d) they can charge me for the usage that exceeds 5GB/month. They can do any, all, or a combination of these things without giving me any written warning, correct?

If this is true, then the Sprint managers can burn in hell in that they are unscrupulous bastards that subscribe to unfair and unethical business practices! Am I pissed? You better believe it!

*flips off Sprint for the second time today*

Oh, ok. Thanks, deparson.

I guess I'm a fool for not reading the fine print.

Sorry everybody, I take back my bad words about Sprint and their management. It was just an emotional reaction.

I apologize for giving you the finger, Mr. Sprint.

I'm still a bit miffed but, yeah, I have no reason to be mad at Sprint for my lack of not reading the fine print. I guess you just can't take a big corporation's "word."

What no input from our reseller 3G? Michael, Alex?? Anything on your end?

If it in fact is true which I have my doubts they will need to supply you the customer a method to track your usage as Verizon does. As long as the current verbage on their site remains the same that they are unable to provide this info I wouldn't sweat it too much.

It all seems a bit presumptive to me at this point with no official notice to me by Sprint, which would have to occur first. I agreed to a specific TOS and if they change it they must notify their customers. Ask Verizon about that.I never plan my day with second hand info. It's counter productive lol!Wink

My plan details are as follows..
Plan details for ***-***-***
Connection Card Data Plan UNL- $59.99
Plan Features:

* $59.99 Connection Card Data Plan
* Unlimited Mb Of Data

* Calls Made On Connection Cards with
* Voice Capability Will Incur a Charge
* Of $.20 Per Minute

I just spoke to Sprint and they tell me there is no change and nothing in the "alert window" either. Well we all now how that goes, BUT they said before any changes could be made to anyones account including the TOS the customer would have to receive a letter first from Sprint. I was told not to worry lol and my plan remains the same as always and described above and the information I received was incorrect.

SO until I receive written notification of a change in my account AND TOS I'm not going to worry about. If I do I'll deal with it then. Any carrier reserves the right to change. That's a given.

Tony

Although it may not be pretty, you can get multiple cards/accounts to cover the excess over 5 Gigs... This may be too obvious to be considered.

What Idiot would do multiple cards at $ 60.00 a pop when one could get a cable modem for about $ 60.00 a month with download speeds much faster then EVDO ?

One that finds the cable would be too long to drag about while traveling... Laughing

At this point some random person ignited this rumor and it is yet unsubstantiated. This very well could be a new change but I believe that Sprint has the responsibility to alert data subscribers to these changes and of course give the option of either grandfathering them to the old terms and conditions or give them the opportunity to leave ETF free.

the best way to monitor your upload/download totals would probably be with net-meter...though if Sprint did it, it'd be much better.

I have the (Employee Discount) unlimited data plan, signed up May 2008. It would be the greatest thing for Sprint to try to cancel me if I went over 5GB, say if I did 30GB a month. Free get out of ETF, and just sign up again and get another data card. Have Rev. A.

Wouldn't surprise me if Sprint someday considers caps as the broadband industry as a whole is heading that way. But they are in no position to have the same caps as competitors. They must differentiate and have higher caps, like 10GB/month or something, just as they added more capability in Simply Everything plan compared to other $99 unlimited voice plans.

I could also see them capping EVDO down the road more than WiMAX to push more users over to WiMAX, though WiMAX won't be broadly available for quite a while.

But there is no confirmation about the Sprint memo. I checked with a couple Sprint employees I know and they haven't seen the memo.
