since sprint will probably end up using a cap, maybe they could at least set it a bit higher? like 10 or 15 GB a month? That way they could stop the 24/7 downloaders switching from verizon, but still offer a incentive to buy sprint instead of At&T or verizon. I do a lot of xbox live, youtube, and my guess on my bandwidth usage is about 8 gb max per month.

I signed up for UNLIMITED data usage and by contract, I expect to have UNLIMITED data usage.

If I tried to break the contact, I'd have to pay an ETF. If they break the contract, what recourse do I have??

Now I can see if I sign up for a new contract at the end of my current one, then, yes, they can tell me that if I go over 5 GB a month then I will be subject to termination or have to overage charges assessed.

BUT, they can't start charging me overage charges in my current contract because I signed a contract for UNLIMITED data usage.

Is what I'm saying make any sense?

Nope. They can change it whenever they want and I am sure there is language in the small print that covers that. Don't pay attention to the barnyard lawyers that talk about class action suits. The best you can hope for is leaving without paying ETF, but where are you going to go? There are more expensive options for higher GB users but those "heavy" users don't want to pay the fee if they can help it. I certainly don't fault them for trying but at the end of the day, what the company considers "normal users" aren't going to hit the 5 GB limit.

I expected a cap would be placed on EVDO at some point. I know the nearest tower to me is loaded up with users. Speeds a year ago were very slow during prime times and have not improved. For Sprint to keep adding T1 lines at cell sites is an added expense and in some locations more T1s are unavailable. WiMAX is on the way. I am certain Sprint will want to convert people using EVDO as their primary Internet connection over to WiMAX when it becomes available.

Ok, sorry to be so airheaded, it shows I used 7237654 Kilobytes last month. That computes to about 7 GB, correct?

Although it may not be pretty, you can get multiple cards/accounts to cover the excess over 5 Gigs... This may be too obvious to be considered.


What Idiot would do multiple cards at $ 60.00 a pop when one could get a cable modem for about $ 60.00 a month with download speeds much faster then EVDO ?

An idiot that lives outside ANY kind of broadband connection short of "satellite".

I wouldnt, i would just bow down the only other option $110 per month for 1mbps down and 512kbps up fixed wireless.

Yes but that guy signed up after March 3rd 2008. I've confirmed with a few customer service reps that after I reach a 5GB limit for the month they reserve the right to throttle my speeds. I don't get charged .49 cents a meg. If I did I'd probably buy another card considering if I went over by 130Mb I'd have the price of 2 cards already on the bill.

Okay, so let me get this all straight from what I'm gathering from all that you guys are saying:

1. Sprint can in fact change my contract in mid-stream? When I signed up a year ago, I made sure that it was UNLIMITED data usage and everybody at Sprint assured me that I don't have to be worried about how much data I'm using. But legally they can change the terms of their contract with me before it reaches its two year term I signed for, right?

2. This won't take effect until July 13th, correct? So I can use all I want until that time. After July 13, I have to watch that I don't go over 5GB/month, correct?

3. They can do a variety of things if I go over the 5GB limit: a) they can throttle back my speed b) they can limit the amount of data I use from that point on c) they can terminate my service d) they can charge me for the usage that exceeds 5GB/month. They can do any, all, or a combination of these things without giving me any written warning, correct?

If this is true, then the Sprint managers can burn in hell in that they are unscrupulous bastards that subscribe to unfair and unethical business practices! Am I pissed? You better believe it!
