In a NYtimes business article today there was some brief mention of the recently announced mobile media plans (channels?) by MTV and Comedy Central:

As is usual, not a mention regarding how accessing that media may in fact violate your wireless carrier's Terms of Service for your EVDO plan.

    1)How will newly emerging streaming media sources/services and hardware like SlingBox or Tivo PVR's impact your use (violation?) of your EVDO connection and the carrier's ToS?

    2)If you haven't subscribed to EVDO service, would that impact your decision to do so?

    3)If you were a subscriber already, would you limit your streaming access or consider dropping your carrier due to the potential of violating the ToS?

    4)Will you merely turn a blind-eye to the ToS and hope for the best?

^Sprint does not restrict streaming video on EVDO, in fact they promote it. Verizon's TOS offically says streaming video is not allowed except what is offered by them. Verizon seems to be enforcing the TOS in some ways but I don't know if streaming video is one of them.

Sprint's 'Yes you can' ad campaign is maybe not as bogus as it sounds when compared to Verizon specifically stating, 'No you can't' in their TOS.

Hmmm... can't seem to get this set as a 'poll' as intended... what am I missing?

Just answer the 4 questions for now folks, never mind the poll. Not looking for ** vs ** comparisons, mainly whether you want to access streaming media (video or audio) and how or whether Terms of Service would impact those desires.

I have two days to go on my 30 days (Cal). Were I to know for sure that streaming were banned I'd end my contract immediately in the next two days and go hunting for HSDPA, which is available from Cingular and functioning here in San Diego. Not as well covered as EVDO yet, but present and expanding here.

I suspect that once Release A rolls around this will be a moot point.

By the way, here in El Cajon (15-20 miles from San Diego proper) the past two days have been *horrendous* with EVDO. Periods of fast connects and then periods of practically no connects, or minimal ones at 12kbps down. I had to set my 620 to do both protocols and ended-up getting a boost to about 50 down and 12 up. Very exciting and I'm dancing with joy. In a fast period now: fast meaning halting, starting and halting. At least no long periods of nuttin' right now.

Everything's tweaked and set properly - been having days and days of fast connects recently in this exact location - so I'm fairly sure it's not at my end. Nex
