There really should not be a capacity problem for either carrier. Few people are really using the capacity they have, and even the best EVDO transfer rate is limited by the nature of the connection. The probability that large transfers between midnight and 6am degrades anybody's performance is pretty low.

I don't think "private lines or frame relay connections" is so much about DSL/Cable replacement - either way, the more restrictive part of the TOS for Sprint is "systems that drive continuous heavy traffic or data sessions". That can easily be used to set an arbitrary limit on transfers if Sprint finds the need.

But terminating customers' accounts is not in the long-term interest of either company. They only do so because they don't know how to manage their networks properly.

Don't forget that for EVDO there is no "code dvision" as there is for 1xRTT, only time division. The capacity question is not about back haul limitation but about the sharing required for any type of multiple usage. The only way that there is no capacity issue is for there never to be more than one user at a time.

The probability of large transfers degrading anyone's service is exactly the same as the probability of having more than a single user on a (RF) carrier. I would think this value should be expected to increase with sales of EVDO devices. I think I've already noticed degradation in the ~5 months I've been watching and measuring. However, midnight to 6AM is indeed a most likely time to be the sole user of a carrier.
