Misleading Rebates

I sometimes answer calls from my neighbors to help out with EVDO stuff.

One of them, recently told me that they found a place that sold EVDO cards for great deals. The pricing was $149.99 for the KPC650 (with 2 year agreement), BUT they offered a $50 mail in rebate, to bring the cost down to $99.99

I checked with this site and they did offer the same price $149.99, however no rebates - so it seems that the rebate may be better. However, I looked at the conditions of the rebate and it said:

Buy online or through our customer service department and get a $50 mail-in rebate to use towards the purchase price of select phones with a new plan activation. How the heck is that a rebate? They are just giving you $50 off if you buy another phone with another 2 years of service. I call that a coupon vs. a Rebate.

How many people are misled by rebates like this? How many don't read the fine print? The site was called LetsTalk.com

I told my neighbor that this is really the best place to buy, they have great support, and the pricing is pretty good too.

Wow, that is misleading. According to the definition:

A deduction from an amount to be paid or a return of part of an amount given in payment.


They are neither reducing the price or returning part of the money.

Any legal people have any comments?
